FAIRCO and FASIC are wholly owned subsidiaries of Transatlantic Reinsurance Company (“TransRe”) engaged in the business of providing insurance. FAIRCO and FASIC (referred to collectively hereinafter as the “Company,” “FAIRCO,” “we” or “our”) respect the privacy of our applicants’ and insureds’ information.
This privacy and security policy (the “Policy”) describes how FAIRCO collects, uses, shares, and protects information in connection with its insurance operations and your use of this website. By using this website, you acknowledge that you have read and understand this Policy. FAIRCO’s website is also governed by our Terms of Use. Certain features of the website may require you to affirmatively accept the Terms of Use before access is granted. 1. What Data Do We Collect?
In providing services to meet your insurance needs, FAIRCO may collect information about you, your business and, if a claim is filed, your business activity, patients, or clients. We handle Personal Information, personal health information or confidential information in accordance with this Policy and applicable laws. As used in this Policy, “Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with an individual.
Applicants. We collect information when an insured applies for a policy, including name, address and other relevant application information that the applicant voluntarily provides to us. In addition, we may collect information about payment history and methods, billing, accounting, and other similar information.
Insureds. Information collected in connection with being an insured includes information about the type of business in which the insured is involved relevant to the policy and coverage. This may include information about training, credentials, work history, and license status. In some instances, a credit check may be conducted on the applicant’s credit history. We may also ask for information concerning past claims by patients, clients or licensing bodies. In the event of a claim or anticipated claim, we collect related claim information to help evaluate and complete the claims process. This may include information related to the nature of the claim, the parties involved, and documentation that supports the underlying claim. Information obtained from a report prepared by an insurance support organization, such as a credit reporting agency, may be retained by the insurance support organization and disclosed to other persons.
Third Parties. FAIRCO may collect information from third party sources to supplement information that we collect. This may include information collected in connection with being an insured or applicant as noted in the preceding paragraphs. This supplemental information allows us to verify
information that is provided to FAIRCO and to enhance our ability to provide you with information about our business, products and services. FAIRCO’s agreements with these third party sources typically limit how FAIRCO may use this supplemental information.
Sometimes the claims information we collect may contain medical- or health-related data, also referred to as Protected Health Information (“PHI”), which is regulated and protected under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”). We may also collect certain Nonpublic Information (“NI”), which is regulated by the Gramm-Leach-Bliley Act (“GLBA”). Other Personal Information we collect may be regulated and protected by the New York Department of Financial Services (“NYDFS”), the Fair Credit Reporting Act (“FCRA”), or other applicable U.S. related privacy and information security laws and which we only share with entities that agree to protect the privacy and security of such data as required by law.
2. How Do We Use Your Data
Application and claim information is used to evaluate underwriting risk, to formulate policy terms, and to assist in claims handling. Information may also be used in furtherance of FAIRCO’s routine business activities, including evaluating and underwriting policies, auditing, establishing pricing and other underwriting criteria, evaluating, processing, paying or rejecting claims, and other purposes authorized by law.
- Respond to inquiries, fulfill requests, complete transactions and otherwise service insurance policies;
- developing products and services;
- conduct research, including trends, usage and advertising-related services;
- enhance safety and security controls and detect and prevent fraud;
- conduct internal audits;
- comply with applicable laws, valid legal processes, and internal policies; and
- respond to government or regulatory inquiries or requests.
3. How Do We Disclose Data?
FAIRCO’s application or other business information may be disclosed to business contacts such as program administrators, managing general agents, insurance brokers, actuaries, accountants, reinsurers and reinsurance brokers, application or IT services providers, and legal counsel to facilitate FAIRCO business objectives. Regulators may also view application or other business information in carrying out their regulatory responsibilities.
We may also disclose your personal information to other companies or individuals outside of FAIRCO for the following limited purposes: (a) satisfy any applicable law, regulation, legal process or enforceable governmental request, (b) enforce applicable Terms of Service, contracts, or policies, including investigation of potential violations or breaches thereof, (c) detect, prevent, or otherwise address fraud, security or technical issues, or (d) protect against imminent harm to the rights, property or safety of its users, or the public as required or permitted by law.
If FAIRCO becomes involved in a merger, acquisition, or any form of sale of some or all of its assets, it will provide notice before Personal Information is transferred.
We may also from time to time use or share aggregated or de-identified nonpublic business or Personal Information for business purposes with business partners.
Lastly, we may disclose Personal Information with your consent.
4. Website Cookies and Web Beacons
FAIRCO’s website uses cookies and similar tracking technologies. These technologies fall into the following categories: (a) Strictly Necessary Cookies, which are essential for website functionality; (b) Performance and Analytics Cookies, which help us understand how visitors interact with the website; and (c) Functional Cookies, which remember user preferences to enhance the browsing experience. FAIRCO does not use cookies for targeted advertising purposes.
You may manage your cookie preferences through our consent preferences tool, accessible via the floating cookie icon displayed on our website, or by adjusting your browser settings. However, please also be advised that cookies may be necessary to provide access to much of the content and many of the features of FAIRCO’s website.
Web beacons may also be used on our website. Web beacons are transparent pixel images that are used to collect information about website usage, email response and tracking. A web beacon can collect information such as a visitor’s Internet Protocol (“IP”) address; the URL of the page on which the beacon appears; the time the page containing the beacon was viewed; the browser type and language; the device type; geographic location; and the identification number of any cookie on the computer previously placed by that server.
Do Not Track. Do Not Track (“DNT”) is a privacy preference setting that users can enable in certain web browsers. DNT is a way for users to inform websites and services that they do not want certain information about their webpage visits collected over time and across websites or online services.

5. Web Server Logs
Certain information is gathered automatically and stored in web server logs for various reasons including administering the site, analyzing trends and tracking usage. This information does not identify individual users. This information may include the following: IP address; type of browser, computer and operating system, browser plug-ins, height and width, Internet Service Provider, search engines, and keywords used to find our site; pages viewed within our site; city, state or country from which our site was accessed, web pages linked to our site from, date and time of visit, pages viewed on our site and other clickstream data.
This site may use Google Analytics, a website analytics service provided by Google, Inc. Google Analytics uses cookies to help website owners understand how visitors interact with the website. Google uses this information to evaluate your use of the website, compile reports for website operators and provide other services related to website activity and internet usage. 6. Children
The website is not directed to children. FAIRCO does not knowingly collect Personal Information from children under the age of eighteen (18) through this website. If you believe we have wrongly collected information from a minor, please contact us at privacy@fairco.com.
7. Information Security
FAIRCO maintains an information security program that includes administrative, technical, physical, and organizational safeguards designed to protect the confidentiality, integrity, and availability of Personal Information. While FAIRCO maintains safeguards designed to protect the confidentiality and security of information in its possession and control, no method of electronic transmission or data storage can be guaranteed to be completely secure. FAIRCO cannot ensure the absolute security of information transmitted to us electronically. We encourage individuals to take appropriate precautions when transmitting sensitive information online, including verifying that you are using a secure connection.
To the extent you or others in your company access information on FAIRCO systems through the use of a password, we ask that you keep your password confidential and secure because we cannot be responsible for acts resulting from the unauthorized use of your password or compromises to the security of your computers, networks or systems.
8. Your Rights
FAIRCO takes reasonable steps to ensure that Personal Information collected, used or disclosed is accurate, up-to-date, complete, reliable and relevant to the purposes for which it is used or disclosed. In the event an individual establishes that their Personal Information is inaccurate or incorrect, FAIRCO will endeavor to promptly correct the Personal Information.
Upon written request, individuals may seek confirmation regarding whether FAIRCO is processing your Personal Information, request access to Personal Information, Personal Information where it is inaccurate or has been processed in violation of a Data Transfer Agreement. Where otherwise permitted by applicable law, you may use any of the methods set out in this Policy to request access to, receive, make portable, restrict processing, seek rectification or request erasure of Personal Information held by FAIRCO. Such requests will be processed in line with local laws. Although FAIRCO makes good faith efforts to provide individuals with access to their PI, there may be circumstances in which FAIRCO is unable to provide access, including but not limited to: where the information contains legal privilege, would compromise others’ privacy or other legitimate rights, where the burden or expense of providing access would be disproportionate to the risks to the Individual’s privacy in the case in question, where it is commercially proprietary, or where such access would be inappropriate. We may charge a reasonable fee to cover the costs incurred in providing a copy of recorded personal information.
State insurance laws may provide you with additional rights regarding your personal information. You may request, in writing, a copy of certain data that we maintain about you to review its completeness and accuracy. To the extent required by applicable law, we have 30 business days after receiving such request to send a copy of the data to you as well as the name and address of any institutional source from which we have received information about you. We may not always be able to grant your request as some data we are not required to share.
If you believe the data we have about you is incorrect, you may notify us in writing of what data you would like to correct, amend or delete and the reason for such request. To the extent required by applicable law, we will respond within 30 business days. If we agree, we will change our records accordingly. We will send the changed data to any organization that has received the inaccurate information from us. The changed data will also be included in any later disclosures to others. If we disagree, we will tell you the reason why. You can provide us with a brief statement explaining why you believe that the data is incorrect and this statement will become part of your records with us. We will also send it to any persons that have received the disputed information from us and will also be included in any later disclosures to others.
9. Retention of Personal Information
FAIRCO retains Personal Information only for as long as necessary to fulfill the purposes for which it was collected, to comply with applicable legal and regulatory record retention requirements (including insurance regulatory retention schedules), and to support FAIRCO’s legitimate business needs. Specific retention periods vary based on the type of data, the nature of the business relationship, and applicable law.
10. Links to Third Party Websites and Other Company’s Privacy Policies
Please note that our website may contain links to other websites for your convenience and information. FAIRCO does not control third party websites or their privacy practices. FAIRCO does not endorse or make any representations about third party websites. Any Personal Information you choose to give to unrelated third parties is not covered by this Policy. FAIRCO encourages you to review the privacy policy of any company or website before submitting your Personal Information.
Some third parties may choose to share their users’ Personal Information with FAIRCO; that sharing is governed by that company’s privacy policy, not this Policy.
11. Changes to our Privacy Policy
We may update this Policy from time to time. If we make changes, we will notify you by revising the date at the top of this policy. We may also provide you with an additional notice (such as by sending you a notification), in connection with making material changes to this Privacy Notice. FAIRCO
encourages you to review this Policy periodically to stay informed about our information practices and the choices available to you.
Your continued relationship with FAIRCO after the posting or notice of any update to this Policy shall constitute your agreement to be bound by any such changes. Any changes to this Policy take effect immediately after being posted or otherwise provided by FAIRCO.
